There is now a global consensus among researchers and decision-makers alike that the risks of algorithmic discrimination are omnipresent and multi-faceted. In this context, guaranteeing equality and combating discrimination requires an understanding of the risks involved and the resulting legal challenges. This presentation will look at the legal guarantees introduced in Europe to combat discrimination and ensure equal treatment. It will focus in particular on the ability of the legislative framework on gender equality and non-discrimination currently in place in the EU to deal with algorithmic discrimination.
This will provide an opportunity to discuss the gaps and weaknesses that are observed at both national and EU level as a result of the interaction between, on the one hand, the specific forms of discrimination that arise when decision-making systems use algorithms and, on the other hand, the particular material and personal scope of the existing legislative framework. In addition, existing legal solutions, accompanying measures and good practice aimed at combating and remedying algorithmic discrimination will also be discussed.
