for a seminar session entitled :
Digital law is a rapidly developing field. In his recent book (Le droit du numérique, Une approche par les risques, Dalloz, 2023), Arnaud Latil sheds light on its history, developments and numerous ramifications in civil law, consumer law and criminal law, as well as in administrative law and fundamental freedoms.
It sees digital activities as the implementation of techniques, in the same way as industrial or scientific techniques. This 'risk-based approach' is now at the heart of European and international public policy. It applies to financial market law, food law and cyber security law. Arnaud Latil explores its three dimensions: the risk-based approach is liberal, preventive and resilient.
Risk law has its roots in the philosophy and sociology of technology. It aims to protect health, safety and fundamental rights by mobilising complex concepts such as trust, neutrality, sovereignty, innovation and resilience. However, risk law is still little known. Yet it is at the root of major changes in our legal systems.
