Avignon University Blogs Charter

Preamble
As part of its policy of disseminating scientific and university culture, Avignon Université offers a blogging service for use by the university community.
This charter sets out the operating rules.

Definition
Blog (contraction of "Weblog")
An interactive online diary based on one or more areas of interest. It allows you to publish your points of view, thoughts and knowledge in real time, in the form of 'notes' distributed to a community of readers.

Site presentation
"Les Blogs d'Avignon Université" is a platform hosted by Avignon Université for the university community to create blogs with an institutional address, and to bring together all resources in a single space.
This platform then becomes a witness to the daily activity of the establishment.
It is a medium for reflection and expression, encouraging exchanges between members of the university community and the public.

Content
The user undertakes not to divulge any information without authorisation allowing the precise identification of other users, members of Avignon Université, himself or herself or any other natural or legal person, such as family name, postal and/or electronic address, telephone number, in compliance with the law of 6 January 1978 amended by the law of 6 August 2004 relating to information technology, files and civil liberties.

Limitation of liability
The web pages of the service may contain hypertext or RSS links to websites managed by external companies or public services (hereinafter referred to as "third party sites") over which the University has no control whatsoever. Avignon Université accepts no responsibility for the content of third-party sites or for the content to which third-party sites may refer. The presence of hypertext or RSS links to third-party sites does not mean that Avignon Université in any way validates these third-party sites or their content. Avignon Université is not responsible for any changes or updates to third-party sites. Avignon Université is not responsible for the transmission of information from third party sites, nor for the malfunctioning thereof. These links to third-party sites are provided for the convenience of users only. Users and/or visitors are solely responsible for any transactions carried out with third parties. Avignon Université cannot be held responsible for information, opinions and recommendations formulated by third parties.

Service
The user agrees not to, and without this list being considered exhaustive, divert the purpose of the service to make propaganda or proselytism, to use his blog for commercial purposes (canvassing, soliciting or prostitution), disseminate content in any form whatsoever that could constitute incitement to suicide, to commit crimes or offences, incitement to discrimination, hatred or violence on grounds of race, ethnicity or nation, apology for Nazism, denial of the existence of crimes against humanity or recognised genocides, undermining the authority of the judiciary, information relating to ongoing trials or an individual's tax situation, dissemination outside authorised conditions of polls and voting simulations relating to an election or referendum, defamation and insult, invasion of privacy or acts endangering minors, as well as any file intended to display prohibited objects and/or works, to disseminate in any form whatsoever information or content including links to third-party sites that are illegal, contrary to accepted standards of behaviour and/or not in keeping with the purpose of the service. Generally speaking, the user undertakes to comply with all the laws and regulations in force concerning the prohibition of the dissemination of pornographic, paedophilic or obscene images, or images that seriously undermine human dignity. In accordance with article 6 paragraph 7 of law number 2004-575 of 21 June 2004 for confidence in the digital economy.

Moderation
For each article or event published, the user is free to open or close comments to the public.
The user is responsible for the content and nature of the messages - voice, sound, text, photos and video - published when using the service.

Administration
Avignon Université reserves the exclusive right to no longer allow the posting of any content that violates the law or public decency without prior warning or justification. Users are expressly informed that the digital content stored on their blog is their sole responsibility. Consequently, only the account holder who has filled in the identification form will assume responsibility, both civil and criminal, for the content stored on his/her blog. We encourage anyone to let us know if they feel that the content of a blog contravenes the law.

Intellectual property and copyright
The user declares that he/she is the legal owner of all content stored and that it is free of all rights if he/she is not the author. The user may not record or transmit content that infringes the intellectual property rights of others, such as, but not limited to, texts, images of people or goods, trade secrets, internal or confidential information. The user may not record or transmit photos that reveal the private or personal affairs of any person. The user undertakes to ensure that each person portrayed has given their consent to the use and distribution of their image. As a reminder: the French Intellectual Property Code only authorises, under the terms of paragraphs 2 and 3 of article L.122-5, on the one hand, only "copies or reproductions strictly reserved for the private use of the copier and not intended for collective use" and, on the other hand, subject to the name of the author and the source, only "analyses and short quotations justified by their critical, polemical, educational, scientific or informative nature", any representation or reproduction in whole or in part, made without the consent of the author or his successors in title, is unlawful (art. L.122-4). Any representation or reproduction by any means whatsoever, in particular by downloading or printing, will therefore constitute an infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code. Any violation of these provisions renders the offender, as well as all persons responsible, liable to the criminal and civil penalties provided for by law. Consequently, the user's content is protected by the intellectual property code, by business secrecy, by the rights of licensors who make this data available on the Internet and by any other third party rights - hereinafter collectively referred to as the "rights".
